Canada Immigration Industry is in Chaos and the Public lost the Confidence in the Minister's Ability and the Way of Managing these Fraudulent Recognizing Authorized Paid Representatives.
WHO SHOULD RESIGN?
There's only so much chaos in the immigration industry that can be controlled I suppose by Minister Kenney, however, Kenney just bought CSIC four extra months of survival kit. Whether the minister, CAPIC or CSIC have breach of their fiduciary duty to the consumer protection that a duty is a legal obligation to treat another person fairly and honestly, and to act only in the best interests of the public.
Has the minister acted in favoring CSIC to collect further 8 million dollars on October 2010 from annual membership dues, or is he avoiding to protect the public and the consumers? Minister Kenney was aware of Nigel Thomson negligence months ago, and also aware of Jeff Hemlin negligence a year ago. Yet, He decided to keep them both to protect the consumer that he is claiming to fight for, for the past two years.
Minister Kenney made many arguments about Ghost Consultants who are not regulated, has he raised an argument about the consultants and the lawyers who are practicing under his authorities and preying everyday on vulnerable victims cashing thousands of dollars in fraudulent way.
Minister Kenney must come clean and straightforward in telling the public of his real intention and not wasting people valuable time, the question is, who comes first to protect, is it to protect the Consumer or CSIC annual budget?
What will happen to CSIC members who forced in paying membership fees on October 2010 but in four months later, CSIC on its exist out if, and when the CIC external analysis chooses a new regulator. Would the minister compensate these members for 8 million dollars knowing that he has no jurisdiction on Ontario Corporation to demand refund for membership fees. Is the minister taken CSIC Members for a fool?
Someone must be accountable for all these inappropriate, unprofessional decisions that the public is witnessing. Canada Immigration consulting regulations becoming the joke of the profession in Canada and certainly left with no integrity but falling into despair and shameful occupation for many who just want out of the Immigration business.
Consultants, Immigration advisors and CIC staff sponsors owe the public a fiduciary duty. Acts of negligence obviously breach this fiduciary duty when CAPIC president and CSIC chairperson failed to carry out instructions on how to protect the consumer and the failure to disclose all material facts regarding their professional negligence.
Those two organizations leaders breaching a fiduciary duty can be held liable for damages caused by their breach to the public and their members to bring shame to the profession. Minister Kenney buying CSIC extra four months of survival kit is another breach of his accountability to protect the consumers.
If both leaders Hemlin and Thomson are acting in negligence and preying on vulnerable victims in the name of being authorized recognized immigration consultants and are in position to lead other consultants into their own traps, then the consumers are under duress and unprotected and Kenney is unable to manage this industry under the Accountability Act.
JEFFREY HEMLIN current president for CAPIC Canadian Association of Professional Immigration Consultants Inc. (CAPIC-ACCPI) has been under CSIC investigation since April 2009 for breaching CSIC Rules of Conduct, this is third CAPIC board director who was caught for professional negligence or breaching CSIC Code of Conduct.
CAPIC former president Phil Mooney was fined $1000.00 dollars for defaming CSIC reputation with other board directors, and currently federal Court case is in proceeding against CSIC board. Mooney said; "Members who do speak out can face disciplinary penalties. Mooney was recently fined $1000 for a website posting calling for the very changes recommended by the Standing Committee to get rid of CSIC.
That matter is now in Federal Court. He is one of several CSIC members in litigation with the Board over alleged violations of their rights under the CSIC By-laws and the Canadian Charter of Rights and Freedoms."
Both organizations CSIC and CAPIC are in lawsuits turmoil against each others that shook the public confidence and Consumer protection.
CSIC current chair Nigel Thomson has been forced to resign on August 28.2010 during CSIC weekend board meeting by the majorities of CSIC members for submitting fraudulent AEO Arranged Employment offer for his clients. CSIC board has been in silence and so far no action has been taken against Nigel Thomson but to continue his unacceptable Immigration practice and to lead this organization CSIC into further shame and despair..
CSIC council opened investigation against Jeffrey Hemlin for the Particulars of the alleged professional misconduct from the Notice of Proceeding dated June 9, 2009: That the member breached: Part 3.2 and Commentary 1.1 of the Rules of Professional Conduct, Part 3.5 of the Rules of Professional Conduct, Part 3.6 and Commentary 1 of the Rules of Professional Conduct, Part 4, Commentary 4 of the Rules of Professional Conduct, Part 4, Commentary 5 of the Rules of Professional Conduct, By-law 10.12(b)(iv), By-law 13.1, and Professional misconduct” within the meaning set out in Rule 2.1, subsection (a)(i) of the Rules of Professional Conduct
According to the minister new criteria for candidates who wishes to regulate Immigration Consultants must provide financial statements for verifications to the Fraud Deterrence and Verifications Division, B1435 at Citizenship and Immigration Canada (CIC) to verify CSIC financial statements for the past five years, and for CAPIC hidden 90.000 dollars membership annual fees which is to date, members never received full explanation who got the money.
Mooney has been attacking CSIC and asked CSIC board to show him the money but he is refusing to show what happened to OPIC $90.000.00 dollars since CAPIC members have been asking him for it for the past five years Funds which disappeared in thin air on January 2005 after OPIC and AICC created CAPIC through amalgamations.
