It is indeed a tragedy that the lawsuit that was commenced by CSIC against Nuha Nancy Salloum and CSIP, of which she is Chairman, has taken so long to settle. I say this because I suspect the fees paid by CSIC Members must be close to a million dollars, maybe even more, and have cost all of us dearly.
The Court ordered that both CSIC and CSIP post on the front page of their websites the following:
On January 2006, the Canadian Society of Immigration Consultants (the “CSIC”) commenced an action in the Ontario Superior Court of Justice against Nuha Nancy Salloum and the Canadian Society of Immigration Practitioners (“CSIP”) for alleged defamatory statements made by the defendants about CSIC and its officers and directors. On March 15, 2006, the defendants defended the action brought against them by the CSIC and issued a counterclaim against the CSIC and its chair, John Ryan, in relation to alleged defamatory statements made by these parties about Nuha Nancy Salloum and the CSIP.
The parties have now settled the above dispute. As a term of the settlement and without any admission of liability, the parties have agreed to a court order, issued on December 18, 2009, that prevents all parties from any future communication of defamatory statements about the other parties, or any of them. In all other respects, the action by the CSIC and the associated counterclaim against the CSIC have been dismissed without costs.”
This money, wasted on lawyers, could have used to fund our Insurance in full, could have been used to reduce our fees or the cost that CMI charges for CPD points.
That having been said, it may also represent a hopeful beginning to a New Year, where we will see some positive and constructive willingness on the part of all the stakeholders to try to unite this Profession rather than engaging in endless and expensive lawsuits.
